Brazil: Investigation opens into group accused of alleged HIV non-disclosure or transmission

The São Paulo Public Ministry (MPSP) is investigating a group calling itself “Clube do Carimbo”, suspected of intentionally spreading the HIV virus , which causes AIDS.

The operation began with the denunciation of an alleged victim, who indicated the existence of the group on Whatsapp, with 126 people.

According to prosecutors, members of the group contaminated people by omitting to disclose that they carry the virus or by damaging the condom before sexual intercourse.

This Wednesday (7th), 12 search and seizure warrants were executed for those involved in São Paulo (who operated in eight municipalities in the state, including the capital) and in Rio de Janeiro. There are also indications of the participation of people living in Minas Gerais and Pernambuco, but they have not yet been identified.

The intentional transmission of the HIV virus is considered a very serious bodily injury crime by the Penal Code, and the penalty can reach up to eight years in prison.

O Ministério Público de São Paulo (MPSP) está investigando um grupo autodenominado “Clube do Carimbo”, suspeito de disseminar, de forma intencional, o vírus HIV, causador da AIDS.

A operação começou com a denúncia de um suposta vítima, que indicou a existência do grupo no Whatsapp, com 126 de pessoas.

De acordo com os promotores, os integrantes do grupo contaminavam as pessoas omitindo que são portadores do vírus ou danificando o preservativo antes da relação sexual.

Nesta quarta-feira (7), foram cumpridos 12 mandados de busca e apreensão dos envolvidos em São Paulo (que agiam em oito municípios do estado, incluindo a capital) e no Rio de Janeiro. Também há indícios da participação de pessoas que vivem em Minas Gerais e Pernambuco, mas elas ainda não foram identificadas.

A transmissão intencional do vírus HIV é considerada crime de lesão corporal gravíssima pelo Código Penal, sendo que a pena pode chegar a oito anos de prisão.
