
Chilanzarsky district court convicted a 45 year-old man for “knowingly exposing his partner to the risk of HIV infection”. According to the judgment, he learned of his HIV-positive status in late 2022 and signed official documents acknowledging both his diagnosis and his legal obligation to disclose it to sexual partners and to take precautions.
However, he entered a relationship with a woman and had repeated unprotected sexual relations, allegedly without informing her of his status. She later tested HIV-positive and reported to investigators that she had never been told about his condition. During the trial, the defendant admitted he had failed to disclose his HIV status and acknowledged that he had only recently started treatment.
The court treated his confession and lack of objection from the complainant as mitigating factors, but also noted previous convictions. He was found guilty under the provision criminalising the knowing exposure of another person to HIV infection and sentenced to two years’ imprisonment in a general-regime colony.
