Uzbekistan: Appeals court upholds prison sentence in HIV exposure case

The criminal cassation panel of the Fergana Regional Court upheld the conviction of a woman previously sentenced for creating a risk of HIV infection.

In a ruling issued on 18 February 2026, the court rejected the cassation appeal filed by the defendant against a judgment of the Fergana City Criminal Court delivered on 20 May 2025. The lower court had convicted her under Article 131(4)(b) of the Criminal Code of the Republic of Uzbekistan.

According to the case file, the defendant had arranged sexual services for a client in an apartment in Fergana and received payment of 1,800,000 soums. Investigators relied on testimony from participants and witnesses as well as audio-video recordings and other evidence gathered during an undercover operation.

The defendant admitted her guilt and requested a non-custodial sentence in her appeal, citing remorse and family hardship, including responsibility for a child and her role as the sole provider for the household.

After reviewing the case materials, the cassation court concluded that the trial court had correctly established the facts and properly applied the law. Finding no grounds to change or overturn the judgment, it upheld the original sentence and dismissed the appeal.
