GREENWOOD, Ind. — Police accuse a Greenwood man of intentionally spreading HIV by not informing his sexual partner.

The 32 year-old is charged with one count of failure to warn of being a dangerous communicable disease carrier, a Level 6 felony.

In Indiana, a Level 6 felony carries a maximum prison sentence of 2.5 years upon conviction.

According to court documents, the man met the victim through a dating app and the two had a consensual sexual relationship. The two were dating for some time before the victim developed health issues and subsequently tested positive for HIV.

The victim told police they were only in a sexual relationship with him and had not tested positive for HIV before the monogamous relationship.

According to court documents, the man is accused of knowing he had HIV and withholding that information from the victim. Investigators even dug up jail forms where he marked “yes” to the question “Do you have HIV or AIDS?”

In Indiana, spreading a serious communicable disease by failing to inform your partner is a crime. It can range from a Class B misdemeanor to a Level 6 felony, depending on whether the action is considered reckless or intentional.
