A musician was arrested in Santa Fe for having infected two women with HIV.
He was denounced for “violation of the law Nº 12.331 – fraudulent contagion of a sexually transmitted disease -, in ideal concurrence with serious fraudulent injuries”.
A musician from the city of Santa Fe was arrested in the last few hours after being accused of having intentionally transmitted the Human Immunodeficiency Virus (HIV) to two women.
The arrest took place this Wednesday morning at a home in the Candioti neighbourhood of Santa Fe, where members of the Operational Investigation Department of the Criminal Investigation Agency (AIC) arrived with an arrest warrant signed by the magistrate Leandro Lazzarini, of the Santa Fe College of First Instance Judges.
Sources in the case told Infobae that the detainee, identified as R.A.F., 42, was informed of the judicial measure in the presence of witnesses and that he did not resist arrest. The authorities informed him of the offence of which he was accused: violation of Law 12.331 – fraudulent commission of a sexually transmitted disease – in ideal concurrence with serious fraudulent injury.
Article 18 of the law states that “anyone who, knowing that they are affected by a transmissible venereal disease, transmits it to another person, shall be punished with the penalty established in article 202 of the Penal Code”. Article 202 of the Penal Code establishes a “penalty of imprisonment or imprisonment of three to 15 years for anyone who spreads a disease that is dangerous and contagious to persons”.
The case against R.A.F. is being investigated by the prosecutor Omar de Pedro. The detainee was housed in a wing of the Las Flores prison awaiting the indictment hearing, which will take place in the next few hours, according to the Public Prosecutor’s Office (MPA).
The latest bulletin on HIV and sexually transmitted diseases issued by the Ministry of Health reported that 140,800 people in the country have the disease. Of the total, 13% are unaware of their diagnosis (which carries the risk of unknowingly transmitting the virus to others) and 30.1% were diagnosed at an advanced stage of the virus.
Official statistics also mention that, on average, about 5,300 new cases are detected each year and that more than 98 per cent of infections are caused by unprotected sex. In addition, it noted that 65,500 people receive antiretroviral treatment in the public system.
In the framework of World HIV Day – celebrated every 1 December – the government formalised by Decree 804/2022, published in the Official Gazette, the regulation of the National Law 27.675 on Comprehensive Response to HIV, Viral Hepatitis, other sexually transmitted infections and Tuberculosis, designating the Ministry of Health as the implementing authority. It establishes a comprehensive approach to health and seeks to provide support and information in order to avoid prejudice.
The published resolution details that the law seeks to “guarantee research, comprehensive and combined prevention, diagnosis, treatment, cure, interdisciplinary assistance (social, legal, psychological, medical and pharmacological) and risk and harm reduction of stigma, discrimination and criminalisation towards people with HIV, viral hepatitis, TB and STIs”.
As a comprehensive response, it also “includes palliative care and rehabilitation of these pathologies, including associated, derived and concomitant pathologies, as well as the adverse effects derived from them and/or their treatments”.

Un músico de la ciudad de Santa Fe fue detenido en las últimas horas al ser acusado de haber transmitido intencionalmente el Virus de Inmunodeficiencia Humana (VIH) a dos mujeres.
El arresto se produjo este miércoles por la mañana en un domicilio de la calle Balcarce al 2.000, en el barrio Candioti de la capital santafesina. Hasta allí se acercaron efectivos del Departamento Operativo de Investigación de la Agencia de Investigación Criminal (AIC) con una orden de detención firmada por el magistrado Leandro Lazzarini, del Colegio de Jueces de Primera Instancia de Santa Fe.
Fuentes del caso comunicaron a Infobae que el detenido, identificado como R.A.F., de 42 años, fue puesto en conocimiento de la medida judicial en presencia de testigos y que no opuso resistencia al arresto. Las autoridades le comunicaron el delito del que fue acusado: violación a la Ley 12.331 -contagio doloso de enfermedad de transmisión sexual-, en concurso ideal con lesiones graves dolosas.
El artículo 18 de esa normativa dispone que “será reprimido con la pena establecida en el artículo 202 del Código Penal, quien, sabiéndose afectado de una enfermedad venérea transmisible, la contagia a otra persona”. El artículo 202 del CP establece una “pena de reclusión o prisión de tres a 15 años para el que propagare una enfermedad peligrosa y contagiosa para las personas”.
La causa contra R.A.F. es investigada por el fiscal Omar de Pedro. El detenido fue alojado en un pabellón de la cárcel de Las Flores a la espera de la audiencia imputativa, que se realizará en las próximas horas, según indicaron desde el Ministerio Público de la Acusación (MPA).
El último boletín sobre VIH y enfermedades de transmisión sexual emitido por el Ministerio de Salud de la Nación informó que 140.800 personas en el país tienen la enfermedad. Del total, el 13% desconoce su diagnóstico (lo que conlleva el riesgo de transmitir el virus a otras personas sin saberlo) y el 30,1% se diagnosticaron en un estadío avanzado del virus.
Las estadísticas oficiales también mencionan que, en promedio, se detectan alrededor de 5.300 nuevos casos al año y que más del 98% de las infecciones se producen por relaciones sexuales sin protección. Además, señaló que 65.500 personas reciben tratamiento antirretroviral en el sistema público.
En el marco del Día Mundial del VIH -celebrado cada 1° de diciembre-, el Gobierno formalizó mediante Decreto 804/2022, publicado en el Boletín Oficial, la reglamentación de la Ley Nacional 27.675 de Respuesta Integral al VIH, Hepatitis Virales, otras infecciones de Transmisión Sexual y Tuberculosis, por la que se designa al Ministerio de Salud como autoridad de aplicación. La misma establece un abordaje integral desde la salud y busca brindar contención e información con el fin de evitar prejuicios.
En la resolución publicada se detalla que la ley busca “garantiza la investigación, prevención integral y combinada, diagnóstico, tratamiento, cura, asistencia interdisciplinaria (social, legal, psicológica, médica y farmacológica) y la reducción de riesgos y daños del estigma, la discriminación y la criminalización hacia las personas con VIH, hepatitis virales, TBC e ITS”.
Al tratarse de una respuesta integral, también se “comprenden los cuidados paliativos y la rehabilitación de estas patologías, incluyendo las asociadas, derivadas y concomitantes, así como los efectos adversos derivados de las mismas y/o de sus tratamientos”.
