Woman paid a fine for nearly infecting her lover with HIV
About a young resident of Berestovitsa complained to the police her partner. He feared that he “caught” HIV from his lover. The fears were not justified, but the woman had to pay a fine in an amount of more than 7 million rubles.
33-year-old woman did not warn her sexual partner that she was living with HIV. About her illness the man learned only after they had an intimate relationship, and soon after … he turned to the police with a complaint to his girlfriend. The woman confessed that she had another lover, to whom she also didn’t disclose her status. As it turned out, none of the partners is not infected. But for the fact that she “exposed them to HIV infection” in her relation a criminal case was filed (Art. 1, Art. 157 of the Criminal Code of Belarus). The Court has defined it as a punishment 7,350,000 rubles fine (35 basic units), told the Hrodno Regional Prosecutor Victor Morozov.
Similar cases continue to be investigated in Hrodno and Slonim, said Senior Assistant Prosecutor of the Hrodno region Vyacheslav Ignatik. Thus, a 53-year-old resident of Slonim transmitted HIV to his partner can get for it up to 7 years in prison. A 34-year-old man transmitted the dangerous infection to four women in Hrodno. He faces up to 13 years in prison.
Now the Prosecutor’s Office together with the doctors and the police will discuss how to reduce the growing number of HIV-positive people. The problematic question: what method should be used to identify people with HIV and those who are in contact with them without violating patient confidentiality. The health department plans to develop an algorithm of actions to exchange this information between medical institutions and law enforcement agencies.

33-летняя женщина не предупредила своего полового партнера о том, что живет с ВИЧ. О ее заболевании мужчина узнал лишь после того, как вступил с ней в интимные отношения, после чего… заявил в милицию на свою избранницу. Женщина призналась, что у нее был еще один любовник, от которого она также скрывала свой диагноз. Как выяснилось, никого из партнеров она не заразила. Но за то, что «поставила их в опасное положение заражения ВИЧ-инфекцией», в ее отношении возбудили уголовное дело (ч. 1 ст. 157 УК Беларуси). Суд ей определил в качестве наказания 7,35 млн рублей штрафа (35 базовых величин), рассказал прокурор Гродненской области Виктор Морозов.

Так, 53-летний житель Слонима заразил свою партнершу ВИЧ и может получить за это до 7 лет колонии. А 34-летний гродненец передал опасную инфекцию четырем женщинам. Ему грозит до 13 лет лишения свободы.
Сейчас прокуратура совместно с врачами и милицией обсуждают, как можно снизить рост количества ВИЧ-положительных людей. Проблемный вопрос: каким способом выявлять людей с ВИЧ и тех, кто с ними контактирует, не нарушая врачебную тайну. В управлении здравоохранения планируют выработать алгоритм действий по обмену такой информацией между медицинскими учреждениями и правоохранительными органами.
