The Kogon City Criminal Court in Uzbekistan convicted a man under Article 113(4) of the Criminal Code for exposing his partner to the risk of HIV transmission.
The court found that the man had been registered with the regional AIDS service since February 2023 and had been warned about HIV transmission, the need to inform sexual partners of his HIV status, and potential criminal liability. Despite this, he had sex on several occasions with his partner between October 2025 and the time of the proceedings, while they were living together.
The defendant admitted the charge and said his partner knew about his HIV status from the beginning of their relationship. He stated that they continued to have sex by mutual agreement and remained together. He expressed remorse and asked the court for leniency, citing his family responsibilities and role as the household’s sole breadwinner.
The partner confirmed that the defendant had disclosed his HIV status when they began living together. She said she had willingly continued the relationship and sexual activity, and that she had tested negative for HIV in August 2026. She had no claim against the defendant and asked the court to take their family circumstances into account. The couple had a child together.
The court considered the defendant’s admission and remorse, his lack of previous convictions, his family circumstances, and the partner’s position as mitigating factors. It also noted that the prosecution had cited the wrong legal provision: the court reclassified the conduct from Article 276⁹(4) to Article 113(4) of the Criminal Code in its former wording, which was in force when the conduct began. The court found him guilty under that provision.
Applying Article 57, the court imposed a sentence of three years’ restriction of liberty. During this period, he must remain at his home outside working or study hours and the time required to travel to and from work or study. He may not change his residence without probation approval or leave Navoi Region. The judgment may be appealed within ten days, subject to the stated procedural rules
