France: Teacher found guilty on two charges but acquitted of deliberate HIV transmission

A former teacher at the Canet-en-Roussillon secondary school appeared before the Perpignan Criminal Court on Thursday, 20 November 2025, charged with ‘corruption’ of former underage students, ‘possession of child pornography’ and ‘administration of a harmful substance resulting in permanent disability’ to another secondary school student. He was ultimately acquitted of the charge of deliberate contamination.

The man, slightly overweight and of conventional appearance, arrived at the Perpignan Criminal Court on Thursday looking rather relaxed. He immediately asked to read the few pages he had written recounting his life. ‘That will be for later.’ First, we will address the charges against him, committed ten years ago, when he was a teacher at the Canet secondary school and deputy headmaster at Argelès-sur-Mer, against six of his former students, aged 15 to 17 at the time. He sent these minors messages containing particularly crude language and images, made inappropriate propositions to them and, in some cases, had sexual relations with them. These were unprotected and he never revealed to them that he was HIV-positive. The mother of one of the boys brought the case to light in 2018 when she revealed to the academic authorities the teacher’s telephone exchanges with her son, including a text message that said: ‘You should take a break from your revision,’ accompanied by a photo of his erect penis.

‘Teacher-student or father-son role-playing’

Today, only two of the alleged victims have brought civil proceedings, but have not found the courage to face him in court. The first (represented by Julie Sala-Polo) was 16 when the teacher contacted him via the gay social network Grindr. The teenager asked him for academic advice. Instead, the defendant led him into ‘a sexual initiation ritual’, encouraging him to perform oral sex on him and promising him future ‘teacher-student or father-son role-playing games’. This was the first intimate relationship for the high school student, who eventually attempted to take his own life while driving a car and developed obsessive-compulsive disorder linked to his fear of sexually transmitted diseases.

The second (represented by Ms. Corine Serfati) was 17 years old. His former teacher, who was twice his age, also found him on the same LGBT website. He too received photographs of his anatomy. And he had sex with the teacher for several months. However, when he turned 18 and went to give blood, he discovered that he had been infected with HIV, before learning that his teacher had hidden the fact that he had the virus from him. Condemned to live with the disease for the rest of his life, ‘without knowing how it might end.’

‘I thought the age of consent was 15.’

The teacher admits to the charges of corruption of minors. ‘On these kinds of sites, these things are quite common, I didn’t think about the consequences,’ he explains. He also admits to possessing child pornography (a thousand images were found). However, he categorically denies knowingly infecting his former student and offers his justifications, backed up by scientific reports. “Hearing that you are HIV-positive is very hard because you are often rejected, which is why I sometimes chose not to disclose this detail so as not to be stigmatised. At that time, I thought that the age of consent was 15, and I didn’t see why you couldn’t have a relationship at that age. What’s more, I was undetectable because I was on triple therapy, and I wasn’t a danger to anyone. In fact, a 2023 WHO report confirms that a person with a viral load below 600 copies/ml of blood is not contagious. ‘

However, his profile does not speak in his favour. For example, he participated in bareback parties and was a member of the WhatsApp group ’POZ team‘ for HIV-positive people seeking condomless sex. The stated goal of this group is to “plomber” (infect) ’negatives”. He had been kicked out of the group for being ‘not HIV-positive enough’ and had tried to stay in it. ‘I can stop treatment to continue and kill young guys,’ he wrote. ‘I said some unfortunate things. It was an exaggeration,’ he now tempers in the dock.

‘You will never have the exact date and proof of contamination.’

The prosecutor, on the contrary, like the psychologist and psychiatrist experts, sees it as ‘a game of manipulation’ and a man prey to ‘a sexual addiction leading him to adopt deviant behaviour without questioning the vulnerability of his partners.’ ‘A difficult case that raises societal questions,’ he summarises, requesting a four-year prison sentence for all the charges, including three years’ probation.

In his defence, Mr Nicolas Nassier has not said his last word. ‘You will never have the exact date and proof of contamination, and for him to be found guilty, he must have been aware that he was administering a harmful substance,’ he argues, pleading for acquittal on the basis of reasonable doubt. And he is partly successful. The court found the teacher guilty of corruption of minors and possession of child pornography, but acquitted him of deliberately transmitting HIV. He was given a two-year suspended prison sentence, banned from working with minors and registered as a sex offender.

Un ex-enseignant du lycée de Canet-en-Roussillon comparaissait ce jeudi 20 novembre 2025 devant le tribunal correctionnel de Perpignan pour “corruption” d’anciens élèves mineurs, “détention d’images pédopornographiques” et “administration de substance nuisible ayant entraîné une infirmité permanente ” à un autre lycéen. Pour la contamination volontaire, il a finalement été relaxé.

L’homme, un peu rond et d’allure classique, arrive d’un air plutôt décontracté ce jeudi face au tribunal correctionnel de Perpignan. D’emblée, il demande à lire les quelques pages qu’il a écrites pour retracer sa vie. “Ça, ce sera pour plus tard.” On va d’abord aborder les faits reprochés, commis voilà dix ans, alors qu’il était professeur au lycée de Canet et proviseur adjoint à Argelès-sur-Mer, sur six de ses anciens élèves, âgés de 15 à 17 ans à cette époque. À ces mineurs, il envoyait des messages aux propos et aux clichés particulièrement crus, il leur faisait des propositions déplacées ou, avec certains, entretenait des relations sexuelles. Non protégées et sans jamais leur révéler qu’il était séropositif. La mère de l’un d’eux a fait éclater l’affaire en 2018 quand elle a révélé aux autorités académiques les échanges téléphoniques de l’enseignant avec son fils et notamment ce SMS qui disait : “Tu devrais faire une pause dans tes révisions”,accompagné d’une photo de son sexe en érection.

“Des jeux de rôle prof-élève ou père-fils”

Aujourd’hui, seuls deux des garçons victimes présumées se sont constitués partie civile mais n’ont pas trouvé le courage de lui faire face à l’audience. Le premier (représenté par M^e Julie Sala-Polo) avait 16 ans quand l’enseignant est entré en contact avec lui via le réseau social gay Grindr. L’adolescent lui a demandé des conseils scolaires. À la place, le mis en cause l’a entraîné dans “un rite d’initiation sexuelle”, l’incitant à lui faire une fellation et lui promettant de futurs “jeux de rôles prof-élève ou père-fils”. La toute première relation intime de ce lycéen qui a finalement tenté de mettre fin à ses jours au volant d’une voiture et a développé des troubles obsessionnels compulsifs liés à sa crainte des maladies sexuellement transmissibles.

Le second (assisté par M^e Corine Serfati) avait 17 ans. Son ancien prof, qui avait le double de son âge, l’a également retrouvé sur le même site internet LGBT. Lui aussi a reçu des photographies de son anatomie. Et il a eu des relations sexuelles avec l’enseignant pendant plusieurs mois. Or, pour ses 18 ans, en voulant aller donner son sang, il a découvert qu’il avait été contaminé par le VIH avant d’apprendre que son professeur lui avait caché qu’il était atteint du virus. Condamné à porter la maladie à vie “sans savoir comment cela pourrait finir.”

“J’avais en tête que la majorité sexuelle était à 15 ans”

Les accusations de corruption de mineurs, le prof les reconnaît. “Sur ce genre de sites là, ce sont des choses assez fréquentes, je n’ai pas pensé aux conséquences”,explique-t-il. Tout comme il admet la détention d’images pédopornographiques (un millier retrouvé). Mais, avoir sciemment contaminé son ancien élève, il nie catégoriquement et sort ses justifications, rapports scientifiques à l’appui. “Entendre que l’on est séropositif, c’est très dur car on est souvent rejeté, c’est pourquoi il m’est arrivé de ne pas donner ce détail-là pour ne pas être stigmatisé. Puis, à cette période-là, j’avais en tête que la majorité sexuelle était à 15 ans et je ne voyais pas pourquoi on ne pouvait pas avoir de relation à cet âge-là. Et puis, j’étais indétectable, car traité par trithérapie, et je n’étais pas un danger pour qui que ce soit. D’ailleurs, un rapport de l’OMS de 2023 atteste qu’une personne ayant une charge virale inférieure à 600 copies/ml de sang n’est pas contaminante. “

Son profil pourtant ne plaide pas en sa faveur. Telle sa participation à des soirées bareback ou son adhésion au groupe WhatsApp “POZ team”, pour séropositifs cherchant des relations sans préservatifs. Dont le but affiché est de “plomber”(contaminer) des “négatifs”. Il en avait d’ailleurs été éjecté car “pas assez séropositif” et avait tenté d’y rester. “Je peux arrêter les traitements pour continuer et crever des jeunes narfs”, écrivait-il. “J’ai eu des paroles malheureuses. C’était de la surenchère”, tempère-t-il désormais à la barre.

“Vous n’aurez jamais la date exacte et la preuve de la contamination”

Le procureur y voit au contraire, comme les experts psychologue et psychiatre,“un jeu de manipulation” et un homme en proie à “une addiction sexuelle l’amenant à adopter des conduites déviantes sans se questionner sur la vulnérabilité de ses partenaires.” “Un dossier difficile qui pose des questions d’ordre sociétal”, résume-t-il, requérant, pour l’ensemble des faits reprochés, une peine de 4 ans de prison dont trois ans avec sursis probatoire.

En défense, M^e Nicolas Nassier n’a pas dit son dernier mot. “Vous n’aurez jamais la date exacte et la preuve de la contamination et pour qu’il soit déclaré coupable, il faut qu’il ait eu conscience d’administrer une substance nuisible“, bataille-t-il, plaidant la relaxe au bénéfice du doute. Et il obtient en partie gain de cause. Le tribunal a reconnu le professeur coupable de corruption de mineurs et de détention d’images pédopornographiques mais l’a relaxé pour la transmission volontaire du VIH. Il a été condamné à 2 ans de prison avec sursis, assortis d’une interdiction d’exercer une activité en lien avec des mineurs et d’une inscription au fichier des auteurs d’infractions sexuelles.
