Sentenced to two years in prison for transmitting HIV to his girlfriend
The Provincial Court of Madrid has sentenced X to two years in prison for transmitting the AIDS virus to his girlfriend, with whom he had unprotected sex, knowing that he was a carrier of HIV.
In a sentence notified this Friday, section 27 of the Madrid Court, chaired by Judge María Tardón, has considered the accused the author of a crime of aggravated injuries caused by serious recklessness, with the concurrence of the circumstance of kinship.
In addition to the prison sentence, the court has ordered that he compensate the victim with 90,000 euros for the injuries caused, including non-pecuniary damage, and has imposed a ban on him from approaching the woman for five years.
The sentence declares proven that X, a carrier of the HIV virus for many years and with medical treatment since 1997, began in 2006 a sentimental relationship with the woman, of Peruvian nationality, “not telling her about such a circumstance at any time, getting to live together at his home shortly after. ”
On two occasions, the sentence indicates, they had unprotected sex of any kind, after which he informed him of his illness but assuring that he had just found out.
The woman took an AIDS test in June 2006, which gave a negative result, although, when doctors explained that there was a period in which the disease could not be detected, it was repeated in October, when she did test positive as HIV carrier.
According to the sentence, the defendant lied by assuring that the relationships had been maintained with a condom and that he has been untrue on several occasions throughout the case. On the contrary, he adds, the victim’s statements have been “fully credible and truthful”, so he considers that it is fully credited that the contagion occurred during the month of May and the first days of June of that year.

La Audiencia Provincial de Madrid ha condenado X a dos años de cárcel por transmitir el virus del sida a su novia, con la que mantuvo relaciones sexuales sin protección a sabiendas de que era portador del VIH.
En una sentencia notificada este viernes, la sección 27 de la Audiencia de Madrid, que preside la jueza María Tardón, ha considerado al acusado autor de un delito de lesiones agravadas causadas por imprudencia grave, con la concurrencia de la circunstancia de parentesco.
Además de la pena de prisión, el tribunal ha ordenado que indemnice a la víctima con 90.000 euros por las lesiones causadas, incluido el daño moral, y le ha impuesto la prohibición de acercarse a la mujer durante cinco años.
La sentencia declara probado que X, portador del virus VIH desde hacía muchos años y con tratamiento médico desde 1997, inició en 2006 una relación sentimental con la mujer, de nacionalidad peruana, “no contándole en ningún momento tal circunstancia, llegando a convivir juntos en el domicilio de él poco después”.
En dos ocasiones, indica la sentencia, mantuvieron relaciones sexuales sin protección de ninguna clase, tras lo que le informó de su enfermedad pero asegurando que acababa de enterarse.
La mujer se hizo una prueba del sida en junio de 2006, que dio resultado negativo aunque, al explicarle los médicos que había un período en el que podía no detectarse la enfermedad, se la repitió en octubre, ocasión en la que sí dio positivo como portadora del VIH.
Según la sentencia, el acusado mintió al asegurar que las relaciones las había mantenido con preservativo y que ha faltado a la verdad en varias ocasiones a lo largo de toda la causa. Por el contrario, agrega, las declaraciones de la víctima han resultado “plenamente creíbles y veraces”, por lo que considera que está plenamente acreditado que el contagio se produjo durante el mes de mayo y primeros días de junio de ese año.
