Uzbekistan: Appeals Court lowers sentence from 2 years to 6 months in HIV-exposure case

In September 2025, the regional appellate court reviewed a criminal case in which the defendant, aware of her HIV-positive status and formally warned by the regional AIDS center not to endanger others, engaged in unprotected sexual relations with another individual, thereby exposing them to infection.

The first-instance court had sentenced the defendant to two years of imprisonment under the relevant provisions of the Criminal Code regarding deliberate transmission of HIV. The defendant appealed, requesting a reduction of the sentence based on her full confession, sincere remorse, absence of prior convictions, the victim’s lack of claims, and her health condition.

The appellate court examined the evidence, including the defendant’s confession, medical registration documents, and statements from the AIDS center, and confirmed the guilt while recognizing the mitigating circumstances. The court determined that the initial sentence was disproportionately severe given these factors.

Verdict: The appellate court reduced the defendant’s sentence from two years of imprisonment to six months, leaving all other elements of the first-instance verdict unchanged. The appeal was partially satisfied.
