
In December 2025, Bogdod District Court convicted a woman living with HIV under Article 113(4) of the Criminal Code for allegedly placing another person at risk of HIV transmission. The court found that, despite being aware of her HIV status and having received prior warnings about criminal liability, she entered into a consensual marital relationship and engaged in sexual relations with her partner. Both parties acknowledged that the partner had been informed of her HIV status prior to the relationship.
Medical testimony confirmed that the woman was on antiretroviral treatment and had an undetectable viral load at the time. Nevertheless, the court held that the mere act of cohabitation and sexual relations constituted “endangerment,” regardless of consent, treatment adherence, or actual transmission. Taking into account mitigating factors—including her remorse, family situation, and lack of prior convictions—the court imposed a suspended sentence with a probationary period rather than immediate imprisonment.
