
The Bukhara Regional Court considered the criminal case against a defendant registered with HIV since August 2019, who had been repeatedly warned about the legal consequences of knowingly infecting others. Between August and November 2024, the defendant had unprotected sexual intercourse with the victim, exposing her to the risk of HIV infection. The defendant fully admitted guilt, expressed remorse, and explained that the victim had no claims against him.
The court reviewed testimony from the defendant, the victim, and a witness, as well as documents from the Bukhara Regional AIDS Center, protocols, and written evidence, confirming that the defendant knowingly endangered another person with HIV, constituting a violation of Part 4 of Article 113 of the Criminal Code of Uzbekistan.
Considering mitigating circumstances—including the victim’s pregnancy, the absence of claims from the victim, the defendant’s confession, remorse, and lack of prior convictions—the court imposed a sentence of 4 years of restricted liberty, to be served at home under probation supervision. The sentence includes restrictions on leaving the home except for work or study and requires reporting to the Probation Department. Precautionary measures previously applied were canceled.
