
On September 19, 2025, the Akdarya District Court for Criminal Cases (Samarkand region, Uzbekistan) convicted a 62-year-old pensioner, under Part 4 of Article 113 of the Criminal Code for “knowingly transmitting HIV” to his wife. According to the court, he was diagnosed with HIV in May 2022, formally warned by health authorities about the legal obligation to prevent transmission, and continued to have unprotected sexual intercourse with his wife, who later tested HIV-positive in May 2025. The defendant admitted his actions in court and expressed remorse, while the victim stated she had no claims against him and requested a non-custodial sentence.
The court considered his confession, cooperation, age, lack of prior convictions, and the victim’s request as mitigating circumstances, concluding that imprisonment was unnecessary. The defendant was sentenced to three years of restricted liberty, reduced to two years, ten months, and nine days after crediting time served under house arrest. The court restricted his movement outside his village and required regular supervision by local authorities. Both parties were informed of their right to appeal within ten days.
