Uzbekistan: Court imposes two-year restriction of liberty for HIV Exposure despite partner’s awareness and consent

On September 17, 2025, the Akhangaran City Criminal Court heard a case involving the deliberate exposure of another person to HIV/AIDS. The defendant, who had been registered as HIV-positive since 2008, knowingly engaged in unprotected sexual intercourse with her partner, who was informed of her status. The partner later tested positive for HIV in March 2025.

The defendant fully admitted her guilt in court, expressing remorse for her actions. The victim confirmed awareness of the defendant’s HIV status, participated in the unprotected sexual activity voluntarily, and did not hold claims against the defendant.

The court found that the actions of the defendant were correctly qualified under Part 4, Article 113 of the Criminal Code, which criminalizes knowingly creating a risk of HIV transmission. Mitigating factors considered included the defendant’s confession, lack of prior convictions, family circumstances, and the absence of claims by the victim.

Verdict: The defendant was found guilty and sentenced to 2 years of restricted freedom. The sentence included limitations on leaving home except for work or school, restrictions on visiting places where alcohol is sold, and remaining within the administrative territory unless authorized by supervisory authorities. The sentence is supervised by the local penitentiary inspectorate, and previous preventive measures were revoked. Noncompliance may result in conversion to another form of punishment.
