Uzbekistan: Court upholds conviction for alleged HIV exposure in Tashkent

In Tashkent, a court reviewed a case concerning an individual who had been previously convicted of multiple offenses, including charges related to the transmission of HIV. According to court records, during an epidemiological investigation in December 2022, the individual was found to be HIV-positive. Despite being formally warned about the legal consequences of knowingly exposing others to the virus, the individual engaged in unprotected sexual activity with an acquaintance between September and November 2023.

The criminal proceedings examined evidence from medical authorities, including certificates from the Tashkent AIDS Center, as well as testimonies from the involved parties. The court considered the circumstances of the relationship between the accused and the affected individual, noting that the accused had been made aware of their HIV status and of the potential criminal liability for endangering another person’s health.

In its judgment, the court re-evaluated the charges and considered mitigating factors, including the accused’s partial confession and lack of prior convictions. The panel ultimately upheld the conviction related to exposing another person to HIV, while adjusting other related charges, resulting in a combined sentence that included imprisonment and correctional labour.
