
The Ellikkalÿ District Court examined the criminal case against a defendant registered with HIV since July 19, 2016, who had been repeatedly warned about the legal consequences of knowingly infecting others. In the summer of 2024, the defendant engaged in unprotected sexual intercourse with his spouse, resulting in her contracting HIV, confirmed by medical tests on September 14, 2024.
The defendant fully admitted guilt, expressed sincere remorse, apologized to the victim, and emphasized that the victim had no claims against him. The court reviewed testimony from the defendant, the victim, and supporting witnesses, as well as official documents from the Republican AIDS Center, registration certificates, counseling reports, and other evidence, confirming that the defendant knowingly exposed another person to HIV, in violation of Part 4 of Article 113 of the Criminal Code of Uzbekistan.
Taking into account mitigating circumstances—including the absence of prior convictions, the defendant’s disability, his role as the sole breadwinner, his remorse, and the lack of claims from the victim—the court applied Article 57 of the Criminal Code and imposed a 4-year sentence of restricted liberty, to be served at home under supervision by the Probation Department. The sentence includes restrictions on leaving the home, alcohol consumption, changing residence or work without permission, and contact with convicted individuals. Precautionary measures previously applied were canceled. The victim retains the right to pursue civil claims for material and moral damages.
