Uzbekistan: Man sentenced to 4 years of house arrest for alleged HIV exposure

The defendant was diagnosed and registered at the Andijan Regional AIDS Center in October 2024. He was officially warned by medical authorities that unprotected sexual contact without disclosing his condition could result in criminal liability under Article 113, Part 4 of the Uzbek Criminal Code.

However, in January 2025, he allegedly engaged in unprotected sexual intercourse without initially disclosing his HIV-positive status. His partner, confirmed their consensual relationship and admitted she was informed about his status before intercourse. She requested legal leniency on Saipov’s behalf and had no material or moral claims.

Despite this, the court found that the defendant knowingly put another person at risk of HIV infection and while acknowledging mitigating factors (partial confession, lack of complaint from the victim, and his role as the family breadwinner), the court also noted aggravating circumstances, including malicious intent and deliberate deception. He was therefore sentenced to 4 years of restriction of liberty.
