
Kuyichirchik District Court in Tashkent region has convicted a man of transmitting HIV to his spouse and sentenced him to four years of restriction of liberty.
According to the judgment of the Kuyichirchik District Court delivered on 9 February 2026, the defendant had been diagnosed with HIV in August 2024 and was registered for medical supervision at the regional AIDS center. At that time he was formally warned by health authorities of his legal obligation to prevent transmission.
The court found that between late 2024 and early 2025 he had sexual relations with his spouse despite knowing his HIV-positive status. The spouse initially tested negative after his diagnosis but was later diagnosed with HIV in February 2025. She testified that she had not had sexual relations with anyone else during that period.
The defendant admitted the facts during the court proceedings and expressed regret. The victim told the court she had no claims against him and asked for a lenient sentence.
The court convicted the defendant under Article 113(4) of the Criminal Code of the Republic of Uzbekistan, which criminalises knowingly exposing another person to the risk of HIV infection or transmitting the virus.
Taking into account the defendant’s admission of guilt, family circumstances, and the victim’s request for leniency, the court imposed a sentence of four years of restriction of liberty rather than imprisonment. The sentence requires the defendant to remain at his place of residence, prohibits him from changing residence without permission, and bars him from leaving the Tashkent region without authorisation.
