Uzbekistan: Woman receives five-year term for second offence of alleged HIV nondisclosure

The defendant, an adult citizen with a previous criminal conviction, had been registered as HIV-positive with local health authorities since 2021. She was receiving regular treatment and had been officially warned about her legal duty not to expose others to the virus.

She was previously convicted in 2023 of the same offense and sentenced to prison. In 2024, a portion of her sentence was converted to a non-custodial restriction of liberty, with several months of that sentence remaining unserved at the time of the current offense.

In late 2024, and in early 2025 the defendant engaged in unprotected sexual intercourse with two different people without disclosing her HIV-positive status. She accepted a small sum of money following the first encounter.

The defendant admitted guilt and expressed remorse, confirming she was aware of the risks and criminal liability involved.

The court found that the defendant’s guilt was fully supported and her conduct was determined to pose a high degree of social danger, especially in light of her prior conviction.

In accordance with relevant provisions of the Criminal Code and sentencing guidelines from the Supreme Court, the court imposed a sentence of 5 years and 1 month of imprisonment, to be served in a general regime penal institution. The remaining unserved portion of her previous sentence was added to the new sentence, as provided under Articles 60 and 61 of the Criminal Code.
