Uzbekistan: Woman sentenced to 2 years and 6 months in open correctional facility for alleged HIV exposure

The defendant, a resident of Andijan District, was charged under Part 4 of Article 113 of the Criminal Code for knowingly putting others at risk of HIV transmission through unprotected sexual contact. The individual had been registered as HIV-positive since 2005 and had received formal warnings regarding the legal consequences of exposing others to infection.

According to the case record and testimonies, in December 2024, the defendant allegedly engaged in unprotected sexual intercourse with one individual after connecting via a social media platform, without disclosing their HIV-positive status.

Again, In June 2024, the defendant allegedly engaged again in unprotected sexual intercourse with a second individual under similar circumstances.
Both complainants testified that they were unaware of the defendant’s medical condition at the time.

The defendant acknowledged the facts in court, expressed remorse, and requested leniency.

The court found the defendant guilty under Article 113(4) and, applying Article 57 (mitigating circumstances) and Article 11 (individualized sentencing), sentenced the defendant to 2 years and 6 months of imprisonment
to be served in an open-type correctional facility.
