In a closed court session in October 2025, the defendant was tried for knowingly exposing another person to HIV infection, in violation of Part 4 of Article 113 of the Criminal Code of Uzbekistan. The defendant had been registered as HIV-positive since 2022 and was officially warned about the legal consequences of transmitting the virus. Despite this, she engaged in unprotected sexual intercourse with her spouse between 2024 and 2025, resulting in the spouse contracting HIV.

The defendant partially confessed during the investigation and fully acknowledged her actions in court, expressing remorse. The spouse confirmed the timeline of cohabitation and unprotected sexual contact, and the transmission of HIV was confirmed through medical testing. Documentary evidence, including medical records, warnings, and investigative documents, supported the findings.

The court considered mitigating factors: the defendant’s confession, remorse, no prior convictions, and the absence of a complaint from the victim. No aggravating circumstances were noted. Applying Article 57 of the Criminal Code, the court imposed a sentence of restricted liberty for 3 years and 4 months, to be served at home with specific restrictions on movement and activities. Compliance will be monitored by the probation authorities. The previous bail was canceled and refunded.
