Bukhara Regional Court considered a case concerning the alleged exposure of another person to HIV under Article 113 of the Criminal Code. The defendant, who had been diagnosed with HIV several years earlier and formally warned of their legal duty to disclose their status and avoid exposing others, admitted guilt.
The court found that the defendant concealed their HIV status and engaged in repeated unprotected sexual relations with the victim, who was later diagnosed with HIV. The victim testified that they were unaware of the defendant’s status at the time of the sexual encounters and had asked about possible illness beforehand. Medical records and documentary evidence supported the finding that the defendant was registered with an AIDS treatment center and had signed an acknowledgment of their obligations.
Taking into account the defendant’s full confession, lack of prior convictions, remorse, caregiving responsibilities for a minor child, and the absence of claims for compensation from the victim, the court imposed a sentence of restriction of liberty rather than imprisonment. The sentence included movement restrictions, prohibitions on attending public venues, and a ban on leaving the region, for a period of four years.
The judgment may be appealed under the procedures set out in criminal procedural law.
