
The defendant, a resident of Karshi city, was officially diagnosed with HIV/AIDS on May 25, 2022. On May 30, 2022, she was formally warned about the legal consequences of transmitting HIV and instructed to use protection during any sexual activity. However, she allegedly engaged in unprotected sexual relationships with at least two individuals between December 2023 and June 2024, without informing them of her HIV-positive status.
Both victims filed formal complaints upon learning of the defendant’s medical condition. Medical tests later confirmed that neither victim had contracted the virus as of early 2025.
The defendant confessed during trial, acknowledging the sexual relationships and her failure to disclose her condition. She expressed remorse, cited her role as a single mother of a minor child, and appealed for leniency. The court considered all evidence and found the defendant guilty under Part 4 of Article 113 of the Criminal Code of Uzbekistan for knowingly putting others at risk of contracting HIV/AIDS. The classification under Part 3(a) (multiple victims) was maintained. She was sentenced to 3 years of restriction of liberty.
All parties have the right to appeal to the Kashkadarya Regional Court of Appeal within 10 days of the verdict announcement (or from the receipt of the written judgment, as applicable).
