Alternatives : Restorative justice

Here you will find resources that focus on restorative justive. [Please note, this section is still under development]

Restorative justice focuses on conflict resolution rather than a punitive approach to the ‘harm’ of HIV non-disclosure, potential or perceived HIV exposure or non-malicious or intentional transmission. It may be a more appropriate way of achieving justice for the complainant in a criminal case, and can help both affected parties find a positive way forward.

According to the UK Restorative Justice Council

In criminal justice, restorative processes give victims the chance to tell offenders the real impact of their crime, to get answers to their questions, and an apology. Restorative justice holds offenders to account for what they have done, helps them understand the real impact of what they’ve done, to take responsibility and make amends.

Alternatives to Criminalization of HIV Transmission and Exposure

In this testimony to the American Bar Association AIDS Coordinating Committee on Criminal HIV Exposure and Transmission Laws in November 2010, Aziza Ahmed, Assistant Professor of Law, Northeastern University School of Law explores alternatives to the use of the criminal law. These include: a supportive legal and policy environment via a human rights framework; and restorative justice via a criminal justice framework. She also adds a note of caution regarding reliance on public health law.
