Uzbekistan: Woman sentenced to 4 years of restricted liberty in HIV criminalisation case

On July 29, 2026, the Sherobod District Court of the Surxondaryo Region, under the chairmanship of Judge T. Turakulov, examined the criminal case in a public judicial session. The defendant was initially placed under a preventive measure of a “written pledge of good conduct”. Due to non-compliance, a search warrant was issued via a court decree on August 20, 2025, substituting her preventive measure with “remand in custody”. She was apprehended on September 24, 2025, and held in custody until October 18, 2025. The final indictment copy was served on June 10, 2026.

  • Article 25, Article 113, Part 4 of the Criminal Code of the Republic of Uzbekistan (earlier version/edition) – Attempted transmission or endangerment of another person with HIV/AIDS.

The court found the defendant guilty of all charges under Article 113, Part 4 and Article 25, Article 113, Part 4 of the Criminal Code. In determining the sentence, the court balanced an aggravating circumstance under Article 56 (committing the act with specific underlying intent) with mitigating circumstances under Article 55 (including her status as a divorced mother of four children, two of whom are minors). Applying Article 57 of the Criminal Code, the court bypassed a sentence of imprisonment. The final sentence was established at 4 years of restricted liberty.
