The 35-year-old man sent a letter to La Brújula 24 to deny the allegations, question the investigation and give his side of the story.

The 35-year-old man who remains in custody on charges of having transmitted HIV to two women without first informing them of his diagnosis has broken his silence and sent a lengthy letter to the editorial team at La Brújula 24 to give his version of events.

F., who is being held at Villa Floresta, rejected the charge, questioned the evidence included in the case and said that his situation amounts to a “criminalisation of HIV”. “I am going to defend myself from here and as best I can,” he stated in one passage of the letter.

The accused explained that he was arrested on 1 June at his place of work, whilst he was with his two four-year-old children, and stated that, up until that point, he had been sharing custody of them. “The purpose of this statement is to make my current situation known, for my own sake, but also because of the harm this situation causes to my children, my wife, my family and, furthermore, to all people living with HIV,” he said. As he explained, the investigation began following a complaint made in 2024 by a woman with whom he had had a relationship. The case file also involves a second woman with whom he had had a relationship. F. is charged under Article 202 of the Criminal Code, which provides for penalties for anyone who spreads a dangerous and contagious disease to others.

The man questioned whether this provision could be applied in his case and asked for Law 27.675 to be taken into account. “They are criminalising HIV,” he argued.

“I am undetectable and non-transmissible”

One of the main arguments set out in the letter is his medical condition. “I am a person living with the virus; my test results show that I am undetectable and, therefore, non-transmissible,” he stated.

He also contested his continued pre-trial detention and insisted that he had never attempted to evade justice. “Together with my criminal defence lawyer, I have always complied with the law whenever required to do so,” he said.

In this regard, he pointed out that he had a fixed address, a stable job, family ties in Bahía Blanca and no criminal record prior to this case.

His account regarding the two women

F. also referred directly to the two women involved in the investigation and refuted various aspects of their statements.

According to his account, one of them does not have HIV, whilst the other does have the virus, although he maintained that there is no scientific evidence to establish that he was the one who transmitted it to her. “In Argentine criminal law, evidence is required, not assumptions,” he argued.

Furthermore, he questioned how test results from his medical records had been obtained and claimed that this documentation had been taken from his home without authorisation. He also stated that there are contradictions between the statements included in the case file and denied that his relationships with the women had the characteristics they described to the courts. “There is no study that can prove this; the alleged intent cannot be proven,” he maintained.

The detainee further emphasised that there is no charge of sexual abuse and pointed out that the encounters under investigation were consensual relations between adults.

“I am no criminal”

Another key point in the letter relates to the public disclosure of his diagnosis. “The law protects the confidentiality of my diagnosis, but the injustice to which I am being subjected puts me under pressure and forces me to reveal my condition,” he said.

F. also claimed that his HIV status had been disclosed in personal and professional circles prior to the court proceedings, something which, he said, ultimately affected his work as well. “The arbitrariness resulting from the misinformation and discrimination I am facing is very painful,” he stated.

More than three months after his arrest, he insisted that the case should be reviewed and demanded his release.

“I am no criminal,” he maintained.

He concluded the letter with a plea to the courts: “I hope this brings about the necessary change and that the phrase ‘justice will be done’—which we read in all the documents and official correspondence—becomes a reality, because there is no crime here.”

The arguments set out above reflect the defendant’s version of events and form part of his defence strategy in a case that is still ongoing and for which he remains in pre-trial detention.

El hombre de 35 años que permanece detenido acusado de haber transmitido VIH a dos mujeres sin informarles previamente su diagnóstico rompió el silencio y envió una extensa carta a la redacción de La Brújula 24 para dar su versión de los hechos.

F., quien se encuentra alojado en Villa Floresta, rechazó la acusación, cuestionó las pruebas incorporadas a la causa y dijo que su situación implica una “criminalización del VIH”. “Voy a defenderme desde acá y como puedo”, expresó en uno de los pasajes del escrito.

El acusado contó que fue detenido el 1 de junio en su lugar de trabajo, cuando se encontraba junto a sus dos hijos de cuatro años, y aseguró que hasta ese momento mantenía con ellos un régimen de cuidado compartido. “El motivo de este comunicado es dar a conocer mi situación actual, por mí, pero también por el perjuicio que esta situación representa para mis hijos, mi mujer, mi familia y, además, para todos los portadores de VIH”, señaló.Según explicó, la investigación comenzó a partir de una denuncia realizada en 2024 por una mujer con la que había mantenido una relación. En el expediente también interviene una segunda mujer con la que había tenido un vínculo. F. está acusado bajo el artículo 202 del Código Penal, que contempla penas para quien propague una enfermedad peligrosa y contagiosa para las personas.

El hombre cuestionó que esa figura pueda aplicarse en su caso y pidió que se tenga en cuenta la Ley 27.675. “Están criminalizando el VIH”, sostuvo.

“Soy indetectable e intransmisible”

Uno de los principales argumentos expuestos en la carta es su situación médica. “Soy una persona portadora del virus, que mis estudios dicen que soy indetectable y, por lo tanto, intransmisible”, afirmó.

También cuestionó que continúe detenido preventivamente y aseguró que nunca intentó eludir a la Justicia. “Junto con mi abogado penalista siempre estuve a derecho cada vez que se me solicitó”, manifestó.

En ese sentido, enumeró que tenía domicilio fijo, trabajo estable, vínculos familiares en Bahía Blanca y ningún antecedente penal antes de esta causa.

Su versión sobre las dos mujeres

F. también hizo referencia directa a las dos mujeres involucradas en la investigación y rechazó distintos aspectos de sus declaraciones.

Según su versión, una de ellas no tiene VIH, mientras que la otra sí posee el virus, aunque sostuvo que no existen elementos científicos que permitan establecer que haya sido él quien se lo transmitió. “En el derecho penal argentino se necesitan pruebas, no presunciones”, planteó.

Además, cuestionó cómo se habrían obtenido análisis pertenecientes a su historia clínica y aseguró que esa documentación fue tomada de su domicilio sin autorización. También afirmó que existen contradicciones entre las declaraciones incorporadas al expediente y negó que los vínculos con las mujeres hayan tenido las características que describieron ante la Justicia. “No existe estudio que pueda revelarlo, no se puede probar el supuesto dolo”, sostuvo.

El detenido remarcó además que no existe ninguna acusación de abuso sexual y señaló que los encuentros investigados fueron relaciones consentidas entre personas adultas.

“No soy ningún delincuente”

Otro de los puntos centrales de la carta está relacionado con la exposición pública de su diagnóstico. “La ley me ampara a la confidencialidad de mi diagnóstico, pero la injusticia a la que estoy siendo sometido me presiona y me obliga a revelar mi condición”, expresó.

F. aseguró además que su situación serológica habría sido difundida en ámbitos personales y laborales antes de la presentación judicial, algo que, según relató, terminó afectando también su trabajo. “La arbitrariedad por la desinformación y la discriminación que están haciendo conmigo es muy dolorosa”, afirmó.

A más de tres meses de su detención, insistió en que la causa debería ser revisada y reclamó recuperar la libertad.

“No soy ningún delincuente”, sostuvo.

Y cerró la carta con un pedido dirigido a la Justicia: “Espero que esto dé el giro que se necesita y que se haga verdad el ‘será justicia’ que leemos en todos los escritos y oficios, porque acá no hay delito”.

Los argumentos expuestos corresponden a la versión del acusado y forman parte de su estrategia defensiva en una causa que continúa en trámite y por la que permanece detenido con prisión preventiva.

The man accused of infecting two women with HIV without informing them of his diagnosis will remain in custody

The investigation alleges that the man, who refused to make a statement, had been aware of his condition since 2016, stopped taking his medication and had sexual relations without warning the victims.

The 34-year-old man, accused of spreading a dangerous and contagious disease, refused to make a statement and will remain in custody, having been arrested several weeks ago by officers from the Bahía Blanca DDI.

The accused was brought before the prosecutor leading the investigation but chose not to make a preliminary statement. He will therefore remain in custody whilst the legal proceedings continue.

According to the investigation, the accused had known since 2016 that he was HIV-positive. The prosecution alleges that he underwent treatment for a period, although he subsequently stopped. The prosecution maintains that he had sexual relations with at least two women without informing them of his diagnosis and without taking any preventive measures. The case concerns two separate incidents. The first is alleged to have taken place in 2021, whilst the second is alleged to have occurred between 2023 and 2024. The complaint was lodged last year, when one of the victims discovered she was HIV-positive during medical check-ups carried out as part of her pregnancy.

According to the investigation, it was in this context that the man admitted he was a carrier of the virus. The woman did not develop the disease, nor was the baby infected, although the prosecution maintains that the offence was nevertheless committed.

Investigators consider it proven that the accused acted with complete indifference to the risk of transmission, concealing his condition from the victims. The prosecution further maintains that both women contracted the virus as a result of this conduct.

The arrest took place in early June, following a series of intelligence operations ordered by the courts to determine the suspect’s whereabouts. Officers established that he was working at a shop on Calle Perú, in the 400s, where he was identified and arrested.

The arrest was carried out by order of Court of Guarantees No. 4, at the request of the prosecuting authority. After being informed of the charges against him, the accused was taken to a police station and remanded in custody.

La investigación sostiene que el hombre, que se negó a declarar, conocía su condición desde 2016, abandonó el tratamiento y mantuvo relaciones sin advertir a las víctimas.

Se negó a declarar y continuará detenido el hombre de 34 años acusado en una causa por propagación de una enfermedad peligrosa y contagiosa, luego de ser arrestado semanas atrás por personal de la DDI Bahía Blanca.

El imputado fue trasladado ante la fiscal que lleva adelante la investigación, pero optó por no prestar declaración indagatoria. De esta manera, continuará privado de la libertad mientras avanza el expediente judicial.

Según la pesquisa, el acusado sabía desde 2016 que era portador de VIH. De acuerdo con la acusación, realizó tratamiento durante un tiempo, aunque posteriormente lo abandonó. La fiscalía sostiene que mantuvo relaciones con al menos dos mujeres sin informarles sobre su diagnóstico y sin adoptar medidas de prevención.

La causa investiga dos hechos distintos. El primero habría ocurrido en 2021, mientras que el segundo se habría desarrollado entre 2023 y 2024. La denuncia fue presentada durante el año pasado, cuando una de las víctimas descubrió que tenía VIH durante controles médicos realizados en el marco de un embarazo.

De acuerdo con la investigación, fue en ese contexto cuando el hombre reconoció que era portador del virus. La mujer no desarrolló la enfermedad y tampoco se produjo transmisión al bebé, aunque para la fiscalía el delito igualmente quedó configurado.

Los investigadores consideran acreditado que el acusado actuó con total indiferencia frente al riesgo de contagio, ocultando su condición a las víctimas. La acusación sostiene además que ambas mujeres contrajeron el virus como consecuencia de esa conducta.

La detención se concretó a comienzos de junio, luego de una serie de tareas de inteligencia ordenadas por la Justicia para determinar el paradero del sospechoso. Los efectivos establecieron que se encontraba trabajando en un comercio ubicado en calle Perú al 400, donde fue identificado y arrestado.

El procedimiento se realizó por disposición del Juzgado de Garantías Nº 4, a pedido de la fiscalía interviniente. Tras ser notificado de los cargos en su contra, el acusado fue trasladado a una dependencia policial y quedó a disposición de la Justicia.

In an operation carried out in the last few hours in Bahía Blanca, personnel from the Departmental Investigations Delegation (DDI) proceeded to the arrest of a 34-year-old man, accused of a reported serious crime: the spread of a dangerous and contagious disease.

According to police sources, the preparatory criminal investigation had begun last year. The suspect is accused of having infected his partner and other occasional partners with HIV, which motivated the Court of Guarantees No. 4 to decree his immediate arrest warrant.

Members of the local DDI, under the directives of the intervening Prosecutor’s Office, initiated various criminal intelligence tasks to find the whereabouts of the accused. The investigators managed to establish that the man was working in his own commercial premises.

Once the police personnel were at the scene and managed to visualize the suspect, they proceeded to his immediate arrest.

The detainee was notified of the content of article 60 of the Code of Criminal Procedure and subsequently transferred to the police station, where the procedures of rigor were held.

The accused will remain at the disposal of the intervening magistrate while the judicial case progresses.

En un operativo realizado en las últimas horas en Bahía Blanca, personal de la Delegación Departamental de Investigaciones (DDI) procedió a la detención de un hombre de 34 años, acusado de un delito informadamente grave: la propagación de una enfermedad peligrosa y contagiosa.

Según fuentes policiales, la investigación penal preparatoria se había iniciado el año pasado. El sospechoso está acusado de haber contagiado de VIH a su pareja y a otras parejas ocasionales, lo que motivó que el Juzgado de Garantías N° 4 decretara su inmediata orden de detención.

Efectivos de la DDI local, bajo las directivas de la Fiscalía interviniente, iniciaron diversas tareas de inteligencia criminal para dar con el paradero del imputado. Los investigadores lograron establecer que el hombre se encontraba trabajando en su propio local comercial.

Una vez que el personal policial se apersonó en el lugar y logró visualizar al sospechoso, procedieron a su inmediata detención.

El detenido fue notificado del contenido del artículo 60 del Código Procesal Penal y posteriormente trasladado a la dependencia policial, donde se labraron las actuaciones de rigor.

El acusado permanecerá a disposición del magistrado interviniente mientras avanza la causa judicial.
