Estonia: Man sentenced to two years and eight months in prison for alleged HIV transmission

The Tallinn-based Harju County Court on Friday handed down a jail sentence of two years and eight months to a man who had unprotected sex with several women after learning that he was infected with the HI virus, and infected two women with the virus.

The court found the 34-year-old man, X, guilty of causing health damage which resulted in danger to life and long-term health damage and handed him a punishment of two years and eight months in jail. To that a punishment for a previous offense is added, meaning that the man must spend three years and six months in jail.

The time of commencement of the service of the sentence starts from Nov. 23, 2016, when the suspect was arrested.

The court established that X was aware of his infection, did not follow a treatment plan, did not take prescribed medication and did not turn up for scheduled check-ups, which means that the probability that the infection will be transmitted was particularly high.

He had unprotected sex with six different partners, whom he did not inform about having the virus.

In two of the women HI virus was found later, which according to the court is long-term health damage that is of permanent nature and poses a danger to life.

Last Wednesday, police arrested a 33-year-old Anton, who is suspected of deliberately spreading HIV. On Friday the Põhja District Prosecutor’s Office applied the pre-trial detention to Anton.

The criminal proceedings were under the country’s Penal Code for causing grievous bodily harm. Now there is reason to believe that Anton knew about the state of his health for about 15 years, but deliberately refused to take his prescribed treatment.

According to the information gathered during the preliminary investigation, the man often found victims in nightclubs. According to the indictment, the man confirmed to one of his sexual partners that he had no sexually transmitted diseases, so she agreed to join him in unprotected sexual intercourse, and was infected with HIV this way. The law enforcement authorities have a reason to believe that a man could have, deliberately hiding his illness, sexual relations with other women.

According to the head of the criminal service in Põhja Prefecture, Rite Picard, currently one victim is known. ‘Data collected during the preliminary investigation indicate that there may be other victims who, without knowing it, can spread the disease. Therefore, the police asked anyone who had sexual relations with the man depicted in the photographs as soon as possible to check their health and turn to the police. Any piece of information is important so that we are able to establish the identity of all of the victims, who may be carriers of the disease are now and do not know about it’, said Picard.

According to the district attorney Anneli Lumiste, at the moment the criminal proceeding is still in its infancy, so now you can not give more detailed information about the collected evidence.

“Since the Prosecutor’s Office had reason to believe that the suspect may continue committing crimes, we have petitioned for his arrest. The collected evidence also points to the fact that there can be more victims than we know at the moment. We are being figuring out the actual number of victims, a lot of help and may be provided by the victims themselves by contacting the police. You should contact the police even in case when HIV transmission has not occurred “, – said Anneli Lumiste.

The police asks anyone who had a  sexual relationship with the man in the photo as soon as possible to undergo a medical test. Уголовное производство ведется по статье Пенитенциарного кодекса о причинении тяжкого вреда здоровью. Сейчас есть основание полагать, что Антон знал о состоянии своего здоровья уже приблизительно 15 лет, но сознательно отказался от назначенного ему лечения. По имеющейся информации, собранной в ходе предварительного следствия, своих жертв мужчина зачастую находил в ночных клубах. Согласно предъявленному обвинению, мужчина подтвердил одной из своих сексуальных партнерш, что у него нет венерических заболеваний, поэтому женщина согласилась вступить с ним в незащищенный половой акт, заразившись таким образом ВИЧ. У правоохранительных органов есть основание полагать, что мужчина мог, сознательно скрывая свою болезнь, иметь половые отношения и с другими женщинами.

По словам руководителя службы криминального бюро Пыхьяской префектуры Райта Пикаро, на данный момент полиции известно об одной пострадавшей. «Данные, собранные в ходе предварительного следствия, указывают на то, что могут быть и другие жертвы, которые, сами того не подозревая, могут распространять эту болезнь. Поэтому полиция просит всех, у кого были сексуальные отношения с изображенным на фотографиях мужчиной, при первой же возможности проверить свое здоровье и обратиться в полицию. Любой фрагмент информации важен для того, чтобы мы смогли установить личность всех пострадавших, которые могут являться сейчас носителями этой болезни и сами не знать об этом», – сказал Пикаро.

По словам окружного прокурора Аннели Лумисте, на данный момент уголовное производство находится еще в начальной стадии, поэтому сейчас нельзя дать более детальной информации о собранных доказательствах.

«Поскольку у прокуратуры было основание полагать, что подозреваемый может продолжить совершение преступлений, мы ходатайствовали о его аресте. Собранные доказательства указывают также и на то, что жертв может быть больше, чем известно на данный момент. Число жертв сейчас выясняется, большую помощь могут оказать и сами пострадавшие, обратившись в полицию. В полицию следует обратиться и в том случае, если заражения ВИЧ не произошло», – отметила Аннели Лумисте.
