Uzbekistan: 2 years of restriction of liberty for man accused of alleged HIV non-disclosure and exposure

The defendant, a seasonal worker residing in Zhalakuduk district, was charged under Part 4 of Article 113 of the Criminal Code for knowingly placing another person at risk of HIV infection. The accused had been officially registered as HIV-positive since July 14, 2018, and had previously signed an acknowledgment of the legal consequences of transmitting the virus to others.

On November 18, 2018, the defendant entered a family relationship with the victim. Despite being explicitly warned by the regional AIDS center not to engage in sexual activity without disclosure and precautions, the defendant allegedly failed to inform the victim of his condition. The relationship continued without protection.

The defendant had a prior conviction in 2011, for which a financial penalty was imposed; however, he had no other criminal record since.

The court found the defendant guilty under Article 113(4) of the Criminal Code and, taking into account the circumstances of the case and applying Article 57 (mitigated sentencing), imposed a custodial sentence below the maximum allowed of 2 years of restriction of liberty. The sentence is to be served at the defendant’s place of residence, under supervision.
