Uzbekistan: Man sentenced to 2 years and 6 months’ imprisonment for HIV transmission and forgery of medical certificate

The defendant was diagnosed with HIV in January 2019 and placed under medical supervision. He was formally warned about the legal obligation to disclose his HIV status but he allegedly did not inform his future spouse prior to engaging in a sexual relationship and later legal marriage. The defendant forged a medical certificate (No. 3781), with help from unnamed accomplices, falsely stating he had no infectious diseases. He had unprotected sexual relations with his partner over an extended period (May 2021 to February 2024), which led to the transmission of HIV to both the partner and their child. In early 2024 he left Russia and the victims were informed of their HIV status by medical authorities in April 2024.

After examining the evidence (his full confession; official medical documentation and forged medical certificate) and taking into account mitigating circumstances (no prior convictions and the fact that his partner asked for leniency), the Court found the defendant guilty of HIV exposure/transmission under Article 113(4) and of document forgery under Article 228(2)(b)

He was therefore sentenced to 2 years’ imprisonment for the HIV-related charge and 1 year and 6 months for the forgery charge leading to a combined sentence of 2 years and 6 months’ imprisonment (per Article 59 of the Criminal Code)

The sentence is to be served in a general-regime correctional facility starting from August 21, 2024.
