A woman was registered as a patient at a regional HIV/AIDS treatment centre since March 2013 and was fully informed and warned against placing others at risk of HIV infection. Despite having signed a written acknowledgment of her legal obligations — including disclosing her status to sexual partners before intercourse — she entered into a relationship with a man she met at a local market in 2017, without ever informing him of her HIV-positive status. The two met regularly and engaged in sexual relations on multiple occasions, including a period of approximately four years during which they lived together in Russia. The last instance of sexual contact occurred on 16 April 2026 at her registered address. The victim testified that he had been entirely unaware of her condition, and only learned of it when law enforcement officers contacted him after the fact. He subsequently underwent medical testing, which did not detect HIV infection. The victim stated he had no claims against the defendant.
The defendant fully admitted guilt, expressed genuine remorse, and requested leniency from the court. She noted that she had never had sexual relations with anyone other than the victim since her diagnosis. The court found her guilt fully established through her confession, documentary evidence from the HIV centre, written warnings she had previously signed, and other case materials. In determining the sentence, the court took into account her full admission of guilt, her gender, her status as the sole breadwinner for three dependent children, her own poor health, and the absence of any civil claim from the victim. These were considered significant mitigating factors, leading the court to apply a below-standard sanction under Article 57 of the Criminal Code.
The defendant was convicted under Article 113, Part 4 of the Criminal Code of the Republic of Uzbekistan and sentenced to 4 years of restricted liberty, to be served at her registered address in Kogon city, with permitted absences only for work or study purposes. Additional restrictions prohibit her from participating in public events, changing her place of residence without probation approval, or leaving Bukhara region. Execution of the sentence was entrusted to the Kogon City Probation Unit.
