A complaint against a pregnant woman with HIV will be filed
Health authorities in coordination with the Ombudsman’s Office will file a criminal complaint against a pregnant woman with the Human Immunodeficiency Virus (HIV) who resists treatment, in order to avoid a case of vertical transmission.
Initially, two cases of pregnant women resisting the protocol were reported. “One case has given up this reluctance to follow the treatment, but another is under constant follow-up,” said José Armando Sandoval, head of the STI/HIV/AIDS programme at Sedes.
The woman in question was diagnosed with HIV at a health centre and did not give details of her address; she is in the last trimester of pregnancy. “We don’t have much time (…), both the mother and the child have the right to health,” Sandoval said.
For this reason, it was decided to take a legal stance together with the Ombudsman’s Office and the Ombudsman for Children and Adolescents and file a complaint for public health violations in order to safeguard the health of the unborn child.
“The sanctions can be from one to ten years in prison in the case of premeditated attempts to transmit HIV,” said Sandoval, recalling that the last known sanction in Chuquisaca occurred in 2014 and corresponds to a sex worker, deprived of her freedom for three years, to continue exercising with a positive diagnosis.
So far this year, 63 HIV patients have been diagnosed, six have died, which raises the case fatality rate to 10% by 2023. Globally, the case fatality rate is 24%, from 1991 to date; there is a commitment to reduce this percentage with earlier diagnosis.
Autoridades de salud en coordinación con Defensorías interpondrán una denuncia penal en contra de una mujer gestante con el Virus de la Inmunodeficiencia Humana (VIH) que se resiste a seguir el tratamiento, para evitar un caso de transmisión vertical.
Inicialmente, se reportaron dos casos de embarazadas que se resistían a seguir el protocolo. “Un caso ha desistido de esta renuencia al tratamiento, pero hay otro en seguimiento constante”, informó el responsable del programa de ITS/VIH/SIDA del Sedes, José Armando Sandoval.
La mujer en cuestión fue diagnosticada con VIH en un centro de salud y no dio detalles de su domicilio; se encuentra en el último trimestre de gestación. “No tenemos mucho tiempo (…), tanto la madre como el niño tienen derecho a la salud”, reclamó Sandoval.
Por ello, se determinó asumir una postura legal junto a la Defensoría del Pueblo y la Defensoría de la Niñez y Adolescencia e interponer una denuncia por atentado a la salud pública para salvaguardar la salud del niño que está por nacer.
“Las sanciones pueden ser de uno a diez años de cárcel en el caso de que de manera premeditada intentare transmitir el VIH”, afirmó Sandoval al recordar que la última sanción conocida en Chuquisaca se produjo el 2014 y corresponde a una trabajadora sexual, privada de su libertad por tres años, al seguir ejerciendo con un diagnóstico positivo.
En lo que va del año se diagnosticaron 63 pacientes de VIH, 6 fallecieron, lo que eleva la tasa de letalidad a 10% este 2023. A nivel global, la letalidad es del 24%, de 1991 a la fecha; hay un compromiso de reducir este porcentaje con diagnósticos más tempranos.
