A judge has set bond for a former Berkeley County employee who faces multiple counts of exposing someone to HIV, court records state.

The 39 year-old man was charged with three counts of exposing another to HIV, according to jail records.

Court records show that a judge set a surety bond of $50,000 on those counts during a Wednesday bond hearing. The judge also ordered him to remain on house arrest.

X allegedly knew about his HIV positive status since approximately 2015, the affidavit says.

In the first charge, court records say the victim reported to the Berkeley County Sheriff’s Office that while he and X met on two separate occasions, the two engaged in sexual intercourse last year in December, and X allegedly failed to disclose he has HIV before, during or after.

In the second charge, the records say the victim met X on three separate occasions last year and engaged in intercourse each time. However, he allegedly failed to tell the victim about his HIV status.

In the third charge, court records say the defendant and the victim have been in a relationship since September 2024 and lived together, often engaging in intercourse. X allegedly failed to ever disclose his HIV status.

Pursuant to South Carolina Code of Laws 44-29-145, it is unlawful for a person who knows they are infected with HIV to knowingly engage in sexual intercourse with another person without first informing that person of their HIV status. A person who violates the law is guilty of a felony.

If found guilty and convicted, X faces up to 10 years of prison or a $5,000 fine.

Berkeley County officials said X, who worked as a dispatch supervisor, has been fired after being charged.
